Last Will and Testament
Holograph Will of Eleanor Frances Whitmore
Article 1. Declaration
I, Eleanor Frances Whitmore, born on 27 November 1949, residing at 88 Spadina Crescent East, Saskatoon, Saskatchewan S7K 3H1, being of sound mind, declare this to be my last will and testament. I make this will entirely in my own handwriting and sign it myself, as a holograph will under The Wills Act, 1996 (Saskatchewan), which permits a will wholly in the testator's handwriting and signed by the testator without witnesses.
Article 2. Revocation
I revoke all wills and codicils that I have made before this one.
Article 3. Family
I am a widow. My husband, Robert Whitmore, died in 2019. I have no children. My closest relatives are my brother, Arthur Whitmore, of Regina, Saskatchewan, and my niece, Grace Whitmore Sandoval, of Saskatoon.
Article 4. Appointment of Estate Trustee
I appoint my niece, Grace Whitmore Sandoval, as the estate trustee (executor) of this will. If she is unable or unwilling to act, I appoint my brother, Arthur Whitmore.
Article 5. Specific Gifts
I give my piano and my collection of Saskatchewan landscape paintings to my niece Grace Whitmore Sandoval.
I give the sum of fifteen thousand dollars (CAD 15,000) to my brother Arthur Whitmore.
Article 6. Charitable Gifts
I give the sum of twenty-five thousand dollars (CAD 25,000) to the Saskatoon Food Bank and Learning Centre, of Saskatoon, Saskatchewan, for its general purposes.
I give the sum of twenty thousand dollars (CAD 20,000) to the Royal University Hospital Foundation, of Saskatoon, Saskatchewan.
Article 7. Residue
I give all the rest and residue of my estate, including my home at 88 Spadina Crescent East and all my bank and investment accounts, to my niece Grace Whitmore Sandoval absolutely. If she does not survive me by thirty days, I give the residue to the Saskatchewan SPCA.
Article 8. Provision for Dependants
Canada has no forced heirship, so I am free to make the charitable and family gifts set out above. My brother and niece are not legally entitled to a fixed share of my estate. I am aware that a court may order support out of my estate under The Dependants' Relief Act, 1996 (Saskatchewan) only for a spouse or a dependant who was not adequately provided for, and I have no such dependant.
Article 9. Funeral Wishes
I wish to be buried beside my husband at Woodlawn Cemetery in Saskatoon. These wishes are a request and are not binding on my estate trustee.
This will is entirely written, dated and signed by my own hand at Saskatoon, Saskatchewan, on [date].
